California. Hear Ye! Hear Ye!

Robert Spencer Douglas, Esquire [#100063], age 64, of Rancho Santa Fe, California has been nom­i­nated by the State Bar of California for induc­tion into the Evil Esquire Bar Association as an asso­ciate member.

Effective September, 23, 2007, Douglas was was sus­pended for two years, stayed, placed on two years of pro­ba­tion with a 60-day actual sus­pen­sion and was ordered to take the Multi-state Professional Responsibility Examination (MPRE) within one year.

Here’s the text of the Cal Bar’s nom­i­na­tion as pub­lished in the California Bar Journal.

Douglass was con­victed in 2004 of 123 mis­de­meanor counts of vio­lat­ing the California Insurance Code.

He oper­ated sev­eral Riverside County bail bond agen­cies and between late 1999 and March 2001, an employee ille­gally solicited and paid more than $20,000 to 509 county jail inmates for bail bond refer­rals, in vio­la­tion of the Insurance Code. Douglass was arrested and an audit showed that he was aware of the unlaw­ful payments.

He was sen­tenced to 93 days in jail, to be served under house arrest, three years of pro­ba­tion and was ordered to pay $425,000 in civil penal­ties and costs. He for­feited his bail license, sold his bail cor­po­ra­tion and is barred from apply­ing for a bail license in the future.

His con­vic­tions did not involve moral turpi­tude but they war­ranted dis­ci­pline.

In mit­i­ga­tion, he has no prior dis­ci­pline record and he coop­er­ated with the bar’s investigation.

Obviously his con­vic­tions war­ranted dis­ci­pline. Sixty days of actual sus­pen­sion and two years of pro­ba­tion. Harsh! But what really must have hurt Robert was hav­ing to take the MPRE again. That’s tan­ta­mount to waterboarding!
