Hear Ye! Hear Ye!
The Evil Esquire Bar Association is seeking public comment regarding the misadventures of California attorney James Mazi Parsa [#102005], prior to accepting nominations for his induction into the EEBA.
On September 17, 2009 James’ lawyer license was suspended by the State Bar of California, effective October 16, 2009, pending the CalBARFOONs consideration of whether or not he is “guilty” of moral turpitude for his guilty plea on May 17, 2001 to two counts of “Unlawful Sexual Intercourse with Person under 18 Years of Age” (California Penal Code § 261.5). James was acquitted of six (6) additional counts including: four counts of “Unlawful Sexual Intercourse with Person under 18 Years of Age”, one (1) count of “Oral copulation of person under 18 years” (California Penal Code § 288a(b)(1)) and one count (1) of “Sexual penetration by foreign object; victim under 18” (California Penal Code § 289(h)). He really got around!
Parsa was sentenced to three (3) years probation and 240 hours of community service but according to the California Sex Offenders Registry, he’s not listed with them. Perhaps the judge believed the fact he’s registered with the State Bar of California was sufficient warning to the public of his predilections?
Given James’ conviction was entered eight (8) years, four months prior to their getting around to temporarily suspending him to determine whether he engaged in “moral turpitude” as a consequence of his conviction for statutory rape, the California Bar must have an enormous pending case load. Either that or James generously “donated” cash to State Bar of California employees and officials in order to keep this under the rug? The latter is certainly plausible given his conviction was exposed by consumer activist Erin Baldwin prior to the Cal Bar taking action. It also explains the Cal Bar’s abysmal lawyer discipline rate and fits with hundreds of anecdotes we’ve received from Californians angry about the dysfunction of their judicial system and the lack of response to issues of attorney and judge misconduct by the Cal Bar, Attorney General, Edmund “Jerry” Brown and the California Commission on Judicial Performance.
Recently anointed State Bar President Howard Miller, Esquire will undoubtedly attempt to spin his organization’s failure to discipline Parsa, in 2001, as an oversight. Caveat Emptor!
Parsa Sues to Silence Consumer Protection Activist
Of course, there’s more to this story than just incompetence or more likely corruption on the part of the State Bar of California et al. According to Baldwin, she and the Bad Biz Finder blog were sued by Parsa Law Group, Law Offices of Jeffrey Cancilla, Law Offices of Craig Laverty, Traut Law Group and UDR, Inc. (NYSE: UDR) in an effort to silence her attempts to protect consumers from being bilked by these firms for, in the case of the lawyers, taking advance fees for providing loan modifications services and failing to do any work (allegedly). In UDI’s case, Bad Biz Finder alleged they were entering into illegal contracts with tenants of their California apartment properties.
After failing to obtain a Preliminary Injunction and Temporary Restraining Order on May 18, 2009, Parsa et al inexplicably succeeded in getting Orange County Superior Court Judge Franz E. Miller, Esquire to reverse “his” decision. On June 2nd, Franz granted a permanent injunction against Bad Biz Finder and Erin K. Baldwin. (see: NYSE:UDR — UDR, Inc. Gunderson Dettmer Abetts Revealing of Activists’ Identity
Parsa et al promptly contacted Toni Schneider, CEO of Automattic (Wordpress’ parent company) who in “consultation” with his lawyers: Thomas Villeneuve, Bob Gunderson, Scott Dettmer, Greg Lemmer, Christina Catzoela, Paul Sieminski, etc. of the illustrious Gunderson Dettmer law firm decided to heed their (purchased?) injunction and shut down Bad Biz Finder’s blog hosted at http://badbizfinder.wordpress.com on Wordpress.com thereby forestalling consumer’s ability to avoid being alledgedly fleeced. According to Ms. Baldwin:
Mr. Schneider illegally provided Parsa Law Group with our proprietary account information and Parsa Law Group stated as such in its pleadings to confirm the identity of our blog owner. Although there was no subpoena, court order, nor any legal reason for him to breach the inherent confidentiality of that information, he did so and he did so at the advice of his attorneys.
Gunderson Dettmer’s advice to Automattic to “illegally” provide Parsa Law Group with “proprietary account information” in order to aide and abet Parsa Law Group’s restraint of Bad Biz Finder’s free speech and press rights, under suspicious circumstances, is certainly not surprising given their employment (read harboring) of Marcia Hatch, Esquirette. Ms. Hatch attempted to engage merchant banking firm Barra Partners, LLC to launder illicit cash of a narcotics trafficker “friend” then, upon her overture being rejected, by at least one Barra Partners member, aided and abetted her husband, Seamus Hatch, and Michael D. Bock, to steal Barra’s assets, then (we believe) confederated with them and others to plan and execute DNS attacks (denial of service) on Godaddy.com, Hosting Panama, Dreamhost.com and Scribd.com (hosted by Softlayer Technologies, Inc) in order to conceal their activities (for a satirical Account of this see: Cyber Attack Tases Scribds Scribes). According to the State Bar of California, they have 222,597 members. Wonder how many more of the Cal Bar’s 222,596 other members are criminals, allowed to continue practicing law at the publics’ peril? Our guess… “a whole bunch.”

Some of Gunderson Dettmer’s clients who will undoubtedly be “amused” to learn their attorneys are harboring Marcia Hatch and have “allegedly” aided and abetted the violation of the free press and speech rights of a consumer rights journalist who was attempting to protect consumers from being fleeced and losing their homes.
they have not paid their contract attorneys for their work. They have shut down everyone’s access to e-mail and the client files. They refuse to answer the phones and have been moving things out. There is a state bar investigation after 5 contract attorneys complained. Check out his website or give his number a call. They both say they will not answer phone calls and will take 14–21 business days to answer e-mails. That is over a calendar month to answer crucial issues as these clients are losing their houses daily.
He also informed NO ONE about his impending suspension. They plan to just let it fold.

Having worked at the CA Bar I mirror your concern this is a case of someone taking money to look the other way. This should have been flagged and dealt with at the time Parsa plead guilty. The question for investigators is whether it was someone at the Orange County Court, the trial counsel’s office or possibly both.
Parsa “resigned” yesterday “due to a 2001 misdemeanor conviction for sex with a child under 18 that he never reported [ed: allegedly] to the State Bar.”
It is obvious that someone was paid off or owed a favor from the start because he was charged with a misdemeanor and got community service. Everybody else is charged with a felony, gets prison time and the attention of their fellow prisoners.
what do we do now? he took our money and ran and our home is still in trouble. we paid them in full in april this year and have yet to hear a final response. can anyone tell us where to look for him to get our money back?
Be certain to file complaints with the State Bar of California, the Attorney General as well as local authorities.

I am a victim. We have been working with Parsa since Feb of 2009. Cooperated with all the documents even paid the fee upfront. I feel so stupid. They said we were almost done. We were taken advantage of and I do not know what to do?

I paid Parsa Law Group money to do a loan modification. Shortly after I ppaid the company closed, his license was revoqued and I want parsa to return my money back! I filed a complain but still no money return. If anyone can help ‚please let me know.
