The Evil Esquire Bar Association is seek­ing pub­lic com­ment regard­ing the mis­ad­ven­tures of California attor­ney Karen Nagad, Esquirette [#102113], prior to accept­ing nom­i­na­tions for her induc­tion into the EEBA.

Karen’s addi­tion to our watch list was pre­cip­i­tated by an anynomous com­plain­tant. According to infor­ma­tion pro­vided to the EEBA, Nagad is a con­fed­er­ate or employee of Adrian Jay Adams, Esquire [#101187], of Adams Kessler PLC, see Adrian Adams, Esquire | ADDED TO EEBA WATCHLIST, herein. According to com­menters, Nadad, Adams et al stir con­flict among mem­bers of HOA’s (home own­ers asso­ci­a­tions) in order to derive legal fees from suing other home own­ers or the HOA. A corol­lary to this alleged busi­ness devel­op­ment strat­egy is a glass com­pany that shoots out win­dows in its trad­ing area to drum up busi­ness. In this case the “shoot­ers” and “glass com­pany” are lawyers, licensed by the State Bar of California, which of course encour­ages such alleged insid­i­ous behav­ior by refus­ing to enter­tain the vast major­ity of com­plaints made by con­sumers. Caveat Emptor!

Anyone with infor­ma­tion regard­ing Nagad is encour­aged to anony­mously com­ment to assist con­sumers of legal ser­vices to assess her char­ac­ter and pro­fes­sional abilities.

Consumers of legal ser­vices in California can­not rely on the Cal Bar to assist them in the event they become a vic­tim of, for instance, one of the 13,529 attor­neys com­plaints were filed against in 2008. Moreover, it is very dif­fi­cult to dis­cern whether or not a lawyer has engaged in “mis­con­duct” or even ille­gal activ­ity because the Cal Bar does not pub­lish the com­plaints they “decline” to inves­ti­gate. California con­sumers “roll the dice” every time they retain a lawyer and one out of twelve times they will make the wrong choice.

Interim Chief Trial Counsel Russell Weiner recently expressed bewil­der­ment regard­ing the num­ber of lawyers prey­ing on con­sumers. “The num­ber of attor­neys using their law licenses to essen­tially take money from unwary but trust­ing con­sumers is astound­ing,” accord­ing to Weiner.

Obviously Russ has been liv­ing in a dif­fer­ent dimen­sion and just rejoined the human race here in real­ity. Each year, for­mal com­plaints are filed against 8.5 per­cent of California’s active lawyer pop­u­la­tion. From 2004 through 2008 the Cal Bar dis­ci­plined only 3.1 per­cent of the lawyers regard­ing whom they received com­plaints. During this period, only 0.8 per­cent of com­plaints received by the Cal Bar from con­sumers of legal ser­vices i.e., vic­tim clients, oppos­ing par­ties, etc. resulted in dis­ci­pli­nary action against the offend­ing lawyer. The only con­clu­sion we can draw from our analy­sis is that the California Bar is highly polit­i­cal– read corrupt.

For decades, California’s lawyers have been given too much lat­i­tude by the State Bar to screw con­sumers of legal ser­vices. The cri­sis Russ finds him­self entwined in has been build­ing for years. Radical left wing pro­gres­sives dom­i­nate the Bar’s pol­icy for­mu­la­tion and have sucess­fully moved it away from its char­ter as an attor­ney reg­u­la­tory body into a polit­i­cal instru­ment. They fork over tens of mil­lions in polit­i­cal dona­tions to the likes of Jerry Brown, Nancy Pelosi, SENATOR Barbara Boxer a/k/a Ma’am and too many state assem­bly politi­cos to count. In return they enact or fail to enact leg­is­la­tion to pro­tect California bar mem­bers’ fran­chise to screw con­sumers. In Jerry Brown’s case he sim­ply refuses to inves­ti­gate alle­ga­tions of attor­ney crim­i­nal acts– until the media picks up on a case.

Empty headed, for­mer State Bar Court Judge JoAnne Earls Robbins who crit­i­cizes California bar pros­e­cu­tors as “unrea­son­ably strict” and advo­cates against per­ma­nent dis­bar­ment as well as numer­ous other California attor­neys who’ve suc­cess­fully lob­bied against allow­ing vic­tims state­ments to be heard and con­sid­ered by the State Bar Court when dis­pens­ing dis­ci­pline are the ground troops in this unde­clared war against lib­erty, jus­tice and the prop­erty rights of Californians. It’s Rome all over again!

While California is cer­tainly in the bot­tom quar­tile of U.S. “attor­ney dis­ci­pline” sys­tems, in our opin­ion, no state ade­quately pro­tects con­sumers.     Your anal­ogy to glass com­pany shoot­ers is a GREAT one!! Karen Nagad and Adrian J Adams sends demean­ing, harass­ing let­ters (that serve no purpose)to res­i­dents who in return, “fight back” to man­age­ment. As a result, the man­ager calls these evils and then AdamsKessler bills the said HOA for thou­sands and thou­sands of dollars!!!!!

    The State of California is fail­ing California con­sumers and home­own­ers again … Adrian J Adams, Esq., the Jessie James of the Southern California HOA land­scap­ing has found per­fect com­pli­ment to his morally chal­lenged and bla­tantly unscrupu­lous “law firm” in Karen Nagad. It has been reported else­where that this mean and sadis­tic women harasses minori­ties and under­priv­i­leged using Adrian J Adams signature.

    This group of lit­i­gants and harassers of home­own­ers move around the town and Southern California from HOA to HOA, steer up prob­lem, advo­cate TRO’s (restrain­ing orders) like snake oil salesman’s advo­cates “snake oil”, with­out scru­ples, moral or eth­i­cal bound­aries. I

    f the same thing was done by non-lawyers, the FRAUDSTERS will be in jail in no time. They do what they want when they want but not before they first intim­i­date HOA Board of Directors by treats of per­sonal lia­bil­ity, which effec­tively dis­arms the Board and keep the Board stand­ing down.

    What Adrian J Adams does with Karen Nagad’s assis­tance can best be described as flat out rack­e­teer­ing, which deserves crim­i­nal inves­ti­ga­tion and prosecution.

    Karen Nagad and Adrian Adams ESQ filed a tem­po­rary restrain­ing order (TRO) against a female res­i­dent in March 2009. They accused her of post­ing fly­ers near his home and send­ing a threat­en­ing fax to Adrian’s office. During the court hear­ing, the hon­or­able Gerald Rosenberg shook his head at both of them in COMPLETE dis­be­lief that not ONE, but TWO offi­cers of the court did this WITHOUT A SHRED OF EVIDENCE!!     In the http://www.davis-stirling.com arti­cle, Ms. Karen Nagad writes about her views on free speech: “There is no “First Amendment right” to such behav­ior and per­sons who engage in it can be ejected from meet­ings and, fol­low­ing due process, fined. If nec­es­sary, boards can seek restrain­ing orders.” Based on the above com­ment, she’s not too suc­cess­ful at obtain­ing restrain­ing orders even with fab­ri­cated evidence.

    What we find so funny is that the BULLY Karen Nagad who works for BULLY Adrian Adams ESQ writes about “other” bul­lies. Perhaps they think they are exempt from this rule since they have earned their ESQ des­ig­na­tion. That means noth­ing to us other than that their bad behav­ior will be sub­mit­ted to the EEBA. Dear EEBA: should we send Ms. Karen Nagad a quick email of what she thinks of her sub­mis­sion to the EEBA? Her par­ents must be proud of all her hard work since they escaped Israel.

    If what you are report­ing is true, as we strongly believe it is, you may wish to file a strong com­plaint against Karen Nagad with the California State BAR, request­ing she is expe­di­tiously rep­ri­manded for mis­lead­ing the court, fab­ri­ca­tion of evi­dence and if the BAR find it appro­pri­ate Karen Nagad should be dis­barred: along with the “gang leader” Adrian J Adams, Esq from Inglewood, CA.

    The Rule: The California State Bar Act pro­vides as follows:

    A. HONESTY REQUIREMENT; PROHIBITION ON DECEPTION
    1) “It is the duty of an attor­ney to do all of the fol­low­ing: *** (d) To employ, for the pur­pose of main­tain­ing the causes con­fided to him or her those means only as are con­sis­tent with truth, and never to seek to mis­lead the judge or any judi­cial offi­cer by an arti­fice or false state­ment of fact or law.” Cal. Bus. & Prof. Code § 6068(d).

    2) “The com­mis­sion of any act involv­ing moral turpi­tude, dis­hon­esty or cor­rup­tion, whether the act is com­mit­ted in the course of his rela­tions as an attor­ney or oth­er­wise, and whether the act is a felony or mis­de­meanor or not, con­sti­tutes a cause for dis­bar­ment or sus­pen­sion. If the act con­sti­tutes a felony or mis­de­meanor, con­vic­tion thereof in a crim­i­nal pro­ceed­ing is not a con­di­tion prece­dent to dis­bar­ment or sus­pen­sion from prac­tice there­for.” Cal. Bus. & Prof. Code § 6106.

    3) “Every attor­ney is guilty of a mis­de­meanor who either: (a) Is guilty of any deceit or col­lu­sion, or con­sents to any deceit or col­lu­sion, with intent to deceive the court or any party. .…” Cal. Bus. & Prof. Code § 6128(a).

    B. ACCOUNTING FOR MONIES RECEIVED

    The Rule: Cal. Bus. & Prof. Code § 6128© pro­vides that “Every attor­ney is guilty of a mis­de­meanor who … [w]illfully receives any money or allowance for or on account of any money which he has not laid out or become answer­able for.”

    C. PROHIBITION AGAINST PRESENTING CLAIM NOT WARRANTED.

    The Rule: Cal. R. Prof. Conduct 3–200 pro­vides as follows:

    “A mem­ber shall not seek, accept, or con­tinue employ­ment if the mem­ber knows or should know that the objec­tive of such employ­ment is:
    (A) To bring an action, con­duct a defense, assert a posi­tion in lit­i­ga­tion, or take an appeal, with­out prob­a­ble cause and for the pur­pose of harass­ing or mali­ciously injur­ing any per­son; or
    (B) To present a claim or defense in lit­i­ga­tion that is not war­ranted under exist­ing law, unless it can be sup­ported by a good faith argu­ment for an exten­sion, mod­i­fi­ca­tion, or rever­sal of such exist­ing law.”

    D. FAILING TO ACT COMPETENTLY
    The Rule: Cal. R. Prof. Conduct 3–110 pro­vides as follows:

    “(A) A mem­ber shall not inten­tion­ally, reck­lessly, or repeat­edly fail to per­form legal ser­vices with competence.

    (B) For pur­poses of this rule, “com­pe­tence” in any legal ser­vice shall mean to apply the 1) dili­gence, 2) learn­ing and skill, and 3) men­tal, emo­tional, and phys­i­cal abil­ity rea­son­ably nec­es­sary for the per­for­mance of such ser­vice.
    © If a mem­ber does not have suf­fi­cient learn­ing and skill when the legal ser­vice is under­taken, the mem­ber may nonethe­less per­form such ser­vices com­pe­tently by 1) asso­ci­at­ing with or, where appro­pri­ate, pro­fes­sion­ally con­sult­ing another lawyer rea­son­ably believed to be com­pe­tent, or 2) by acquir­ing suf­fi­cient learn­ing and skill before per­for­mance is required.”

    Feel Free to repost this sum­mary for use by the pub­lic injured by this ruth­less cabal of extor­tion­ist and harassers.

    E. PROHIBITION AGAINST ADVISING THE VIOLATION OF LAW

    The Rule: Cal. R. Prof. Conduct 3–210 pro­vides that a mem­ber “shall not advise the vio­la­tion of any law, rule, or rul­ing of a tri­bunal unless the mem­ber believes in good faith that such law, rule, or rul­ing is invalid. A mem­ber may take appro­pri­ate steps in good faith to test the valid­ity of any law, rule, or rul­ing of a tribunal.”

    F. PROHIBITION AGAINST THREATENING CRIMINAL, ADMINISTRATIVE, OR DISCIPLINARY CHARGES

    The Rule: Cal. R. Prof. Conduct 5–100(A) pro­vides that a mem­ber “shall not threaten to present crim­i­nal, admin­is­tra­tive, or dis­ci­pli­nary charges to obtain an advan­tage in a civil dispute.…”

    Filing a com­plaint with the State Bar of California is always a good idea. In 99.2% of cases they won’t dis­ci­pline the attor­ney but their responses are very enter­tain­ing and make for great fod­der for the EEBA’s can­nons. Make cer­tain you copy Jerry Brown as cer­tainly he won’t do any­thing either. One of his canned responses is to refer com­plainants to law enforce­ment. Of course Jerry as the Attorney General is California’s chief law enforce­ment offi­cer but appar­ently he really doesn’t like that role.

    Adrian J Adams ESQ and his ter­ror­ist Karen Nagad are straight from Hell!! If “Evil Esquire” were a mag­a­zine, they would be the per­fect mas­cots. Adrian J Adams and Karen Nagad unin­vit­edly attended our Board meet­ings for HOMEOWNERS. Then they billed the asso­ci­a­tion for their hours. Is that pos­si­ble when no retainer agree­ment nor con­tract was signed?? They charged us for NOT ONE but TWO incom­pe­tent attor­neys whose only pur­pose is to bully right­eous home­own­ers into silence. Everything you read is absolutely TRUE!!
    Ms. Karen Nagad is surely a crook and a gullible one too. Adrian J Adams uses Karen Nagad for out­ra­geous tac­tics so Adrian Adams ESQ him­self could evade any BAR inves­ti­ga­tions in the event that any com­plaints were filed!! The days of bul­ly­ing home­own­ers must END. Adrian J Adams has harassed many elderly home­own­ers at the Marina City Club and where there were younger res­i­dents at other con­do­minium projects, they FOUGHT back!! I have to dis­agree that these res­i­dents are under­priv­eleged. It is Adrian and Linda Adams of Inglewood that are under­priv­eled and Karen and Abraham who once lived (or still do) live in that shack in the Fairfax area.

    Karen nagad lieks it because she makes money. According to numer­ous reports, Karen lies very well, with smile and with­out remorse. Certain reports pur­ports she prop­a­gates against First Amendment and has no prob­lem fab­ri­cat­ing evi­dence in cases filed against the asso­ci­a­tion, which she and Adams caused on pur­pose to extort more money for Adams and his cohort.

    I’ve been fol­low­ing this com­ments because Adams is also lawyer at our HOA.

    No one here likes them and huh that women Karen Nagad… Adams tried to force
    her on our HOA. We didn’t like her. She seems very tricky and dishonest.

    Friend at the other HOA told me Karen Nagad and Adams orches­trated elec­tion
    fraud and now their HOA is being sued because of that. Clever thief’s these lawyer are,
    Adams and Karen didn’t live any evi­dence about being involved… nee­dles to say HOA
    will lose a lot of money. Simply, if you have a choice avoid at all cost.

    Karen Nagad, Esq name is syn­ony­mous with the term “CROOK LAWYER”.

    Karen is an immoral and dis­hon­est leach with base­ment type of moral. She chooses to cater to insur­ance com­pa­nies and asso­ci­a­tions because they have money to attack their own mem­bers and clients and because she enjoys unfair, David Vs. Goliath type of fight due to her own insecurities.

    No decent client will hire Karen Nagad.

    According to MANY posted reports Karen Nagad’s vex­a­tious meth­ods revolve around harass­met of home­own­ers and bul­ly­ing of ‘Certain groups ‘(immi­grants, elderly, Muslims, etc) for the sole pur­pose of “easy mak­ing of money” in dis­re­gard of Federal and State law and CA BAR code of ethics.

    Unethical lawyers Karen Nagad,Esq and her despi­ca­ble spon­sor Adrian J Adams, Esq of Adams Kessler, PLC should be sued and dis­barred if found liable for harass­ment and inten­tional inflic­tion of emo­tional dis­tress upon pro­tected groups.

    Karen Nagad a.k.a. “Unstable Karen” was report­edly involved deeply in the BIG CONSTRUCTION SCAM that took place in LA Mirabelle HOA. The dol­lar amount of the dam­age done to our home­own­ers was nearly $2Mill due to over­charg­ing and ter­ri­bly shoddy work­man­ship by unli­censed Iranian and Armenian con­trac­tors, who were notably close friends of the cer­tain Board members…and their named coun­selors. (Karen Nagad is report­edly Iranian who ben­e­fit from pro­tect­ing over­priced contracts).

    There were also alle­ga­tions that liti­gious Karen, vul­ture Adrian Adams, and Mathew “Nutcase” Gardner got very fat checks to bully and harass home­own­ers who dear oppose ruth­less over­pay­ment of con­trac­tors for the pur­pose of col­lect­ing kick­backs. To pre­vent the home­own­ers form real­iz­ing their legal rights, this trio of crooks threat­ened res­i­dents con­tin­u­ously with fines, Board hear­ings and Restraining Orders. In all these numer­ous let­ters they stated no fact or had any legal bases to harass res­i­dents, yet they con­tin­ued to do so until they were threat­ened back with restrain­ing orders by resident’s attorneys.

    Farsi speak­ing “homeowner-harasser” KAREN NAGAD a.k.a.“UNSTABLE KAREN” ren­o­vated her par­ents home recently using “blood money” she received from mas­ter harasser Adrian J Adams, Esq in exchange for bul­ly­ing home­own­ers and fil­ing fraud­u­lent Restraining Orders against these who asked mis­be­hav­ing Board for accu­rate account­ing of their HOA Money.

    As she did this know­ingly, and as she aided and abet­ted Board member’s and man­agers breach of fidu­ciary and such utterly dis­hon­est con­duct in spite of the fact that these requests were homeowner’s legal right, Karen Nagad a.k.a. “Unstable Karen” should be disbarred.

    Karen Nagad also goes by name Karen Yaghoubieh and more. Some reports sug­eat that she was shopli­fitng while she was in school and she allegedly injure a man by scratch­ing his face to hurt him…

    Beware, this relent­less con­fed­er­ate harasser-lawyers work from their homes and are report­edly dis­guis­ing their iden­ti­ties under one another’s names to con­fuse the issue, and to appear deceit­fully as a big­ger firm, to avoid being sued and other legal con­se­quences for HARASSMENT OF HOMEOWNERS.

    If you encounter this hate­ful and unscrupu­lous per­son, or any of the Adams’ “bul­lies”, do not hes­i­tate, at once report her to BAR and do not respond to her harass­ing let­ters. Harassment is ille­gal, by fil­ing sim­ple ‘STOP HARASSMENT” forms in Court you may eas­ily bring an ANTI HARASSMENT action against KAREN NAGAD, ADRIAN ADAMS or any­one else harass­ing you, to STOP their unlaw­ful conduct.

    Keep in mind, you do not need to take lawyers’s abuse. The law still applies on their con­duct as it applies on any­one else’s. Asking for TRO is nearly free and for that you do not need a lawyer. You can do it your­self. On the other hand the lawyer assisted law­suits are costly; don’t let your­self being suck­ered into the law­suit that only makes this gang of uneth­i­cal coun­selors richer. Fill up the forms and file a TRO action against. There is noth­ing there to lose by try­ing to pro­tect your prop­erty, peace, tran­quil­ity, and right to quite enjoyment.

    BEWARE: If Adams Kessler PLC is work­ing with your Board of Directors, they are NOT work­ing for you home­own­ers. Period. There is no ifs, buts or sim­i­lar. Numerous Court Cases shows clearly that law­suits were filed and mas­sive amounts of home­own­ers money was wasted at the asso­ci­a­tion in which Adrian J Adams, Esq advised crook Board Members in vio­la­tion of law and aided and abet­ted a breach of fidu­ciary duty for the pur­pose of fleec­ing the HOA with enor­mously high legal bills.

    Do you want to be next? Do you wan to pay spe­cial assess­ment to fill the cof­fers emp­tied there var­i­ous fraud schemes assisted by this uneth­i­cal group of lawyers?     Greetings! Speaking of ethics, Karen’s ethics can be described as non exis­tent or at best, the size of a poppy-seed. She hides behind the “priv­i­lege” of a coun­selor to mask her own sadis­tic needs and tendencies.

    Karen joined the firm of Adams Kessler after learn­ing what an easy fod­der Condo Homeowners were for “can­nons” of a nasty HOA lawyer Adrian J Adams, Esq. She loved how Adams per­fected the art of scam with­out being cought and he made a lot of money by installing and defend­ing mangers he farms on his employ­ment sec­tion of the Davis Stirling website.

    You are appar­ently 100% right Kim. KAREN NAGAD is a very uneth­i­cal per­son. There is another crooked lawyer who now try to enter the Homeowner skim­ming arena. His name is Raymond N. Szu, who accord­ing to Google is also an degen­er­ate gambler.

    Does any­one know if Raymond Szu works for Adrian J Adams or if they are in any way related?
