Marlene Garcia of 1521 Bella Vista Ave., in Coral Gables has been nominated by the Florida Bar for induction into the Evil Esquire Bar Association. Admitted to practice in 1987, Garcia was suspended effective immediately, following a December 8, 2008 court order. According to the Florida Bar: “Garcia was suspended following her pleading guilty in circuit court (in July, 2008) to cocaine purchase/possession with intent to purchase, a felony.”

He wasn’t actually suspended for two years! Instead the CalBarFOONS stayed the suspension and placed him on three years of probation with a 60-day actual suspension or until he made restitution and passed the MPRE.

Attention all lawyers fond of cocaine, forgery, and deceit: You won’t make partner at Holland & Knight, but that doesn’t mean they won’t hire you. Just ask Theodore S. Silva Jr., a former Holland & Knight partner who has been publicly reprimanded by the Virginia Bar for pleading guilty to a felony charge of possession of cocaine (charges were ultimately dismissed for Silva’s compliance with court orders), failing to report the cocaine arrest, failure to pay Virginia Bar dues, and failing to maintain his CLE or “continuing legal education” credits. We applaud the Virginia Bar for its staunch enforcement of its CLE requirements, for who knows how different things could be if Mr. Silva had the benefit of an annual ethics class.

On this date in the Golden State the illustrious State Bar of California suspended (interim) James M. Kummerer, age 62, of Columbus, Indiana after he was convicted of felony cocaine possession. He’d been charged with conspiracy to deal cocaine and possession of more than three grams. The charges were enhanced because at the time of his arrest he was within 1,000 feet of a school.
